LANDLORD’S AGREEMENT TO LEASE THE CONDOMINIUM

Property Manager is leasing the Condominium to Occupant because of Occupant’s promise to pay the Rent and to keep all other promises and agreements described in this Agreement. The promises, terms and conditions of this Agreement are stated below.

PAYMENT AGREEMENT

One third (1/3) of the total property rent is due at the time of booking, so if paying by money order or personal check, it must be received within seven (7) days of booking. The remaining balance plus a $200.00 refundable security deposit is due thirty (30) days prior to Occupant’s arrival. This means that the Property Manager MUST RECEIVE all payments on time so that Property Manager does not have to ask Occupant to make payment.

CANCELLATION POLICY

We are offering an exceptionally low rate on this property. In order to do so, we must make your one third (1/3) down payment nonrefundable in the event that you cancel your reservation and we are unable to rent out that time slot. You will be refunded your one third (1/3) down payment if you cancel and we are able to occupy your cancelled reservation.

SECURITY DEPOSIT

Your security deposit will be returned to you within thirty (30) days after check out date and pending a thorough inspection of the property. Both the Property Manager and Mr. Go Clean will perform a detailed inspection of the property. Photographs will be taken before and after each rental. It is solely up to you whether your security deposit is refunded. So care for the property and you will be caring for your security deposit.

Occupant is not responsible for reasonable wear and tear.

The Property Manager may deduct expenses from the security deposit if:

  • Property Manager must repair damage(s) to the property
  • Occupant fails to return the keys to the Property Manager and new keys and changing of locks have to be performed. Key(s) are expected to be mailed back to the Property Manager within a few days of check out. Unreturned keys will cause a delay in the Occupant receiving his or her $200 refundable security deposit. If you have misplaced your key, please notify the Property Manager right away. A charge of $10 will be deducted from your $200 refundable security deposit for lost keys.

An itemized list of deductions will be sent to the Occupant thirty (30) days after the Occupant vacates the property and returns the property keys to the Property Manager. Any remaining security deposit will be returned to the Occupant within thirty (30) days with the itemized list of deductions, if any.

PETS

Pets shall NOT be permitted on the Property.

PROPERTY USE

The Occupant shall not sell or assign this Agreement or sublet the Property. The property is to be occupied only by the persons or entities that have signed this agreement.

IN CASE OF EMERGENCY

In case of emergency, the Property Manager may enter the unit without the consent of the Occupant. Otherwise, upon reasonable notice (approximately 24 hours) to the Occupant and at reasonable times (9 a.m. to 9 p.m.), the Property Manager may enter the Property to:

  • Make necessary repairs, alterations or improvements

FURNISHINGS

The Property Manager shall provide:

  • Bedspreads, toaster, coffeemaker, and furniture. The Occupant shall supply bed linens, towels and basic kitchen items including but not limited to, tinfoil, napkins, and food.
  • It is the Occupant responsibility to notify the Property Manager of any damage or malfunction of any supplied appliances including but not limited to refrigerators, washers, dryers or air conditioners. The Property Manager will make every reasonable effort to have such appliance(s) promptly repaired.

TRASH

The Property Manager shall provide an appropriate receptacle for the collection of trash. The Occupant shall be responsible for removal from the Property and placement in the provided receptacles of such trash, garbage or other waste to the designated trash dumpster located on the premises nearest the pool.

DAMAGE

The Occupant shall not deliberately destroy, deface, damage or impair any part of the Property including but not limited to fixtures, appliances or facilities or permit any other person to do so. Additionally, the Occupant shall be responsible for any damage caused by his failure to comply with this requirement.

CONDUCT OF OCCUPANT

The Occupant shall conduct himself and require other persons on or within the Property, whether known to the Occupant or not, to conduct themselves in a manner that will not disturb the neighbors of the Property. Further, the Occupant does promise and agree that he will not use or permit the Property to be used in an illegal, immoral, hazardous, noisy, offensive or inappropriate manner. Any fine levied against the Owner, caused by the Occupant, Occupant guests, visitors or others resulting from such misuse, shall become the responsibility of and be paid by the Occupant.

BREACH OF AGREEMENT

If Occupant breaches any term or condition of this agreement, the Property Manager shall have the power and authority to enter onto and repossess the Property. The Property Manager will have the Occupant and other persons who are on or within the property removed with or without the Occupant’s permission along with the goods, possessions and assets of the Occupant or other such persons without liability for such entry, repossession or removal of those items. Additionally, the Property Manager will hold the Property as if this agreement was not made except that all amounts paid to the Property Manager shall be considered forfeit and shall remain with the Property Manager as applicable.

AGREEMENT ACKNOWLEDGEMENT

The Property Manager, Denise M. Phillips, puts this agreement into action. Occupant has read and fully understands the terms and conditions mentioned in Sections 1-13. Occupant agrees to make payment as indicated in Section #2 and agrees to the stated terms of returning Occupant Security Deposit in Section #4. This agreement is binding upon the execution of the Occupant and the Property Manager.
